The forum could be a district consumer disputes redressal forum, state consumer disputes redressal commission, or the national consumer disputes redressal commission, depending on the value of the claim.
  • Complaint Format: The complaint should be in the prescribed format and include details such as the name and address of the complainant and the respondent (business), a concise statement of the facts of the case, the relief sought, and supporting documents.
  • Service of Notice: Once the complaint is filed, a copy of the complaint is served to the opposite party (business), who is given an opportunity to respond within a specified time.
  • Evidence and Arguments: Both parties have the opportunity to present evidence and arguments supporting their case during the proceedings. This may include documents, contracts, invoices, photographs, or witness testimony.
  • Mediation/Conciliation: In some cases, the consumer forum may attempt to resolve the dispute through mediation or conciliation, where a neutral third party helps the parties reach a mutually acceptable settlement.
  • Adjudication: If mediation fails or if either party refuses to participate, the forum proceeds to adjudicate the case based on the evidence and arguments presented. The forum will issue a judgment, typically within a specified period, either granting or denying the relief sought by the consumer.
  • Appeals: Either party dissatisfied with the decision of the consumer forum may appeal the decision before the state or national consumer disputes redressal commission, depending on the value of the claim.
  • Execution of Order: If the consumer forum grants relief to the consumer, the business is required to comply with the order within the specified time frame. Failure to comply may result in further legal action, including fines or penalties.
